Terms and Conditions

The following terms and conditions apply to all website development / design services provided by Web4u (Trading as Joomlafactory) to the Client.

Terms and conditions may be updated from time to time.

1. ACCEPTANCE

It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to      the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.

2. OUR FEES AND DEPOSITS

A 60% deposit of the total fee payable under our proposal is due immediately upon you instructing us to proceed with the website design and development work. We reserve the right not to commence any work until the deposit has been paid in full. All prices listed are in South Africa Rand. The remaining 40% shall become due when the work is completed to your reasonable satisfaction but subject to the terms of the “approval of work” .

3. REFUND POLICY

Our refund policy works as below:

Refund not applicable on domain registration fees.
Refund not applicable for express service clients.
Refund not applicable for any delays out of our control.
Refund not applicable once website is completed (Live website).
Refund not applicable on web hosting fees.

4. CLIENT REVIEW

Web4u will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed and the site has been published and is active on the internet.   At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Web4u otherwise within five (5) days of the date the materials are made available to the Client.

5. TURNAROUND TIME AND CONTENT CONTROL

Web4u will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at date agreed with Client upon Web4u receiving initial payment, unless a delay is specifically requested by the Client and agreed by Web4u.

In return, the Client agrees to delegate a single individual as a primary contact to aid Web4u with progressing the commission in a satisfactory and expedient manner. If at any given stage a new delegate is provided by the client and he or she wishes to change the direction of which the previous person agreed on (example, theme, colours, content etc) Web4u will bill extra to cover additional time spend on project.

During the project, Web4u will require the Client to provide website content; text, images, movies and sound files.

6. FAILURE TO PROVIDE REQUIRED WEBSITE CONTENT

Web4u is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged.

This is why we ask that you provide all the required information in advance. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge of up to 25%.

If you agree to provide us with the required information and subsequently fail to do within one week of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, all the above says is, do not give us the go ahead to start until you are ready to do so.

NOTE: Text content should be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages. Contact us if you need clarification on this.

Using our content management system you are able to keep your content up to date yourself.

7. PAYMENT

Invoices will be provided by Web4u upon completion but before publishing the live website. Invoices are normally sent via email.

8. ADDITIONAL EXPENSES

Client agrees to reimburse Web4u for any additional expenses, for work not previously agreed upon, necessary for the completion of the work. Examples would be: purchase of special components, modules, stock photography etc.

9. COPYRIGHTS & TRADEMARKS

The client must obtain all necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks, or any other material that you supply to us to include in your website or web applications. You must indemnify us and hold us harmless from any claims or legal actions related to the content of your website.

10. SEARCH ENGINES

All websites designed by us are search engine friendly. However we do not guarantee any specific position in search engine results for your website. We perform search engine optimisation according to current best practice at an additional cost.

11. WEB BROWSERS

Web4u makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 11, Google Chrome, etc.). Client agrees that Web4u cannot guarantee correct functionality with all browser software across different operating systems.

Web4u cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website has been designed and handed over to the Client. As such, Web4u reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.

12. DESIGN CREDIT

A link to Web4u will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied.

13. ACCESS REQUIREMENTS

If the Client’s website is to be installed on a third-party server, Web4u must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP / Cpanel (Access to create database). Depending on the specific nature of the project, other resources might also need to be configured on the server.

If Web4u is the hosting services provider, and the client requested cpanel details, please note once cpanel login details are provided to the client Web4u can not be held responsible for any site issues.

14. POST-PLACEMENT ALTERATIONS

Web4u cannot accept responsibility for any alterations caused by a third party occurring on the Client’s site once installed. Such alterations include, but are not limited to additions, modifications or deletions.

15. DOMAIN NAMES

Web4u may purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Client. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Web4u . The Client should keep a record of the due dates for payment to ensure that payment is received in good time.

16. GENERAL

These Terms and Conditions supersede all previous representations, understandings or agreements. The Client’s payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions. Payment online is an acceptance of our terms and conditions.

17. RIGHT OF REFUSAL

Web4u reserves the right to refuse or terminate service to anyone for any reason not prohibited by law. Also we have the right to be free from acts or threats of disruptive behaviour, abusive and/or offensive language, including intimidation, harassment and/or coercion, which involve or affect our operation. Abusive communications in any form (email, phone, in person, etc.) are strictly not tolerated. No refund would be provided in case of abusive communications.

18. UPDATE OFF TERMS AND CONDITIONS

We reserve the right to update our terms and conditions.
